1. Scope of Agreement

• These Terms and Conditions of Use ("Agreement") are between you ("You" or "User"), whether an individual, survivor, practitioner, student, or professional, and ITR Training Institute, LLC ("ITR," "we," "us," or "our").
• This Agreement governs your access to and use of HelpForTrauma.ai, including all AI-guided tools, written materials, videos, exercises, dashboards, and other content (collectively, the "Platform").
• By accessing or using the Platform, you agree to be bound by this Agreement.
• ITR may update these Terms from time to time. Changes will be posted on the Platform, and continued use constitutes acceptance.
• 👉 Privacy Policy: Your use is also governed by our Privacy Policy, which explains how information is collected, stored, and used. You must review and accept it during registration.

2. Eligibility and Age Restriction

• HelpForTrauma.ai is intended only for individuals who are 18 years of age or older.
• By using the Platform, you represent and warrant that you are at least 18 years old and legally able to enter into this Agreement.

3. Nature of the Service

A. AI-Guided Educational Platform

• HelpForTrauma.ai is an AI-guided educational platform designed to support self-directed learning and awareness related to trauma recovery concepts.
• AI-generated content is informational and educational only
• AI responses are not a substitute for professional judgment
• AI outputs may be incomplete, inaccurate, or not appropriate for your specific situation

B. Human Support (Technical Only)

Any human assistance offered through HelpForTrauma.ai is strictly limited to technical support, including:

• Account access issues
• Platform functionality
• Navigation or troubleshooting

Human support personnel do not provide:

• Therapy, counseling, coaching, or treatment
• Crisis intervention
• Clinical interpretation
• Personalized mental health guidance

4. No Emergency Use

• HelpForTrauma.ai is not intended for emergency use.
• If you are experiencing suicidal thoughts, self-harm urges, or a mental health crisis, do not use this Platform. Contact emergency services or a crisis hotline immediately.

5. Content Disclaimer and Assumption of Risk

All content on the Platform may change at any time.

The Platform:

• Does not diagnose conditions
• Does not recommend treatments
• Does not provide therapeutic services

You acknowledge that:

• Trauma responses vary widely
• Self-guided tools may not be appropriate for everyone
• You assume full responsibility for how you use the information provided

Engaging with trauma-related educational content may involve emotional or physical reactions. You agree to use the Platform at your own pace and discontinue use if distress arises.

6. Licenses and Intellectual Property

Your License

ITR grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for:

• Personal educational use, or
• Professional educational use (if you are a provider), excluding public redistribution

Provider Use

Providers may use Platform content privately or in small group settings but may not publicly distribute, resell, republish, or commercialize Platform materials without written permission.

User Submissions

If you submit content ("Submissions"):

• You retain ownership
• You grant ITR a non-exclusive, royalty-free, perpetual license to use Submissions consistent with the Privacy Policy

You represent that your Submissions:

• Are your own or lawfully licensed
• Do not violate the rights of others
• Do not contain unlawful or harmful material

ITR may remove Submissions at any time without notice.

7. No Representations as to Accuracy

• ITR makes reasonable efforts to provide quality content but does not guarantee accuracy, completeness, or outcomes.
• Third-party content is not owned or endorsed by ITR.

8. Availability of the Platform

• Platform availability depends on factors outside ITR's control, including internet connectivity.
• ITR does not guarantee uninterrupted or error-free access.

9. Copyright (DMCA)

All copyright and infringement procedures are governed by the Digital Millennium Copyright Act.

10. Links to Third-Party Sites

The Platform may contain links to third-party websites. ITR is not responsible for third-party content and does not endorse such sites. Use them at your own risk.

11. Governing Law and Jurisdiction

• This Agreement is governed by the laws of the State of West Virginia, without regard to conflict-of-law principles.
• Any claim must be brought within one (1) year of the event giving rise to the claim.

12. International Use

If you access the Platform outside the United States, you are responsible for complying with local laws and regulations.

13. Warranty Disclaimer & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

To the maximum extent permitted by law:

• ITR disclaims all warranties
• ITR is not liable for indirect, incidental, or consequential damages
• Total liability shall not exceed the amount paid by you to ITR in the one (1) month prior to the claim

14. Indemnification

You agree to indemnify and hold harmless ITR from claims arising from:

• Your use of the Platform
• Your Submissions
• Your violation of this Agreement

15. No Therapeutic or Professional Relationship

Use of the Platform does not create a therapist-client, clinician-patient, fiduciary, partnership, employment, or agency relationship.
